Here is some general information you may find helpful, if you are a personal injury victim.
IF YOU HAVE AN AUTOMOBILE ACCIDENT.
After the accident, you must make sure that you contact your insurance agent and report any damage to your car and any injury that was caused to you and/or any of your passengers. Make sure you have all of the other driver's information including; insurance, ownership and name and address. When the police officers arrive, make sure you find out what police precinct or state trooper barracks the officer is located. It is important to file certain papers promptly, such as an accident report with the NY Department of Motor Vehicles. No fault insurance forms should be requested and filled out--to ensure that your medicals are paid for.
You are also entitled to 80% of your wages up to $2,000.00 a month. (Some additional coverage is available so be sure to have your attorney check and see if you have any Additional Personal Injury Protection.)
If you are critically injured, your first and foremost task is to get the proper medical care.
Never speak to a claims adjuster or the other driver, unless, you are not injured and are trying to settle the damage to your car. Never give them permission to tape record the interview if you are injured. A simple , on the advice of counsel , answer is sufficient.
Get to a lawyer as soon as possible if you are seriously hurt. There are many things that a knowledgeable personal injury attorney can do for you, if the case is brought to his attention immediately.
Never mislead to your attorney, the truth works wonders. If you have been hurt in that same part of your body before let your lawyer know. If the injury seriously aggravated your pre-existing injury you may still be entitled to compensation.
SLIP AND FALL--TRIP AND FALL
Many innocent people are very seriously injured by slip and falls, and trip hazards. If contacted promptly, your lawyer can help you.
Always have a family member take a series of photos from different locations. If and ice and/or snow caused your injury, then it is important to take pictures of the area around the accident to show possible reasons for the ice and/or snow.
Also, have someone measure, if possible, the length and width of the slippery spot. If lack of lighting is an issue, take a photo showing how near or far the outside lighting was.
Alternatively, if your injury was caused by a trip, measure the height of the obstruction. If it is over 1/4 of an inch the landlord may be liable. As always, take pictures. In these type of cases, one picture of the obstruction with a ruler and one without can be very helpful to your attorney.
If your injury occurs inside of any building, store, or mall–make sure you ask employees if they knew of the obstruction or wet spot.
In order to be successful in these kind of cases, we must prove actual or constructive notice. This means that the dangerous area existed long enough that the landowner or store knew or should have known of the dangerous condition and did nothing to take care of it.
We hope that this information was helpful. Although an injury is obviously the most traumatic part of being a victim–the legal process can also be harsh. It is important that your attorney can provide you with in-depth answers to your valid questions.
